One problem is justly distinguishing "us" from "them" and another is justly acting up on these distinctions.

I have no idea if I'm part of "us" or "them" by your criteria.

It is obvious to me that we have to distinguish actions rather than people groups. Once we distinguish the actions, we then have to act in a way that does not contradict our original complaint about those actions. If the complaint, for example, is terrorism, then we should not act as terrorists. If the complaint is killing people without due process, then we should not kill people without due process.
